General
Does the rent break apply to me as well?
This depends on where you live, your flat and your tenancy agreement. The rent cap only applies in certain towns and municipalities, and there are legal exceptions, such as for certain new-build properties or the first letting following extensive modernisation. A higher previous rent may also be a factor. With our free rent check, you can find out whether the rent cap generally applies to your flat.
How much does RentAid cost?
The initial assessment is free of charge and comes with no obligation. If RentAid takes on your case, you won't have to pay any upfront costs or bear the agreed financial risks of legal proceedings yourself. RentAid only receives a success fee from the rent refunds recovered from your landlord if we successfully secure a rent reduction or refund for you.
How much can I save with the rent break?
That depends on how much your current rent exceeds the permitted rent and how long your tenancy has been in place. If, for example, your rent is 200 euros too high per month, a successful rent reduction would mean a saving of 2,400 euros per year. Depending on the terms of your tenancy, you may also be entitled to a refund of any rent you have already overpaid.
How does RentAid work?
First, check your rent with RentAid free of charge and with no obligation. If you may be eligible under the rent break / rent control scheme, we will assess whether we can fund the further enforcement process. In suitable cases, experienced partner lawyers will take on your legal representation. RentAid funds the agreed costs of enforcement. You only pay RentAid a fee if the case is successful.
What happens if we lose the case?
In that case, you won’t pay anything – neither to us nor to an opposite lawyer or the court. RentAid bears the financial risk.
Why a success fee – what exactly am I paying for?
Our success fee represents the value of us assuming the entire risk associated with legal costs: we advance the costs of lawyers, court fees and legal proceedings – if a case is lost, we bear these costs, not you.
What’s more, without this funding, most tenants would not be able to enforce their claims in the first place; it is only through this funding that a theoretical right is turned into actual money.
And there is a principle of solidarity: successful cases help to fund the unsuccessful ones. This is the only way we can enable everyone to seek justice without having to pay upfront and without bearing any financial risk. In the end, you receive half of a sum that would otherwise have remained with the landlord.
Do I retain my ownership of the claim?
Yes. Your claim remains yours. Our partner lawyers will enforce it on your behalf.
Success Fee
What is the success fee?
RentAid only receives a success fee if we successfully secure a rent reduction. Tenants pay no upfront costs and face no risk of having to cover legal fees or court costs. If your rent is not reduced, you pay nothing.
How much is the success fee?
Our success fee is 40% (including VAT) of the rent refunds recovered from your landlord. You receive the remaining 60% of the refunds. Any future savings from your reduced rent are entirely yours as well.
Sample calculation
You have been paying €250 too much rent every month for 12 months. After RentAid notifies your landlord, it takes, say, a further three months for your rent to be reduced.
Until the claim is raised:
12 × €250 = €3,000 refund
→ €1,800 for you
→ €1,200 for RentAid
During the following 3 months, until the matter is resolved with your landlord:
3 × €250 = €750 further refund
→ €450 for you
→ €300 for RentAid
Once your rent has been reduced:
€250 a month for you
What does that mean for me?
Of a total of €3,750 in recovered rent, you receive €2,250. From then on, you will permanently pay €250 less rent per month – a saving of €3,000 a year.
In this example, RentAid receives a total of 1.500,00 € in success fees. If RentAid neither recovers any money for you nor reduces your rent, RentAid receives nothing.
As the sample calculation shows, the actual remuneration is based on the repayment claims successfully enforced (where applicable) and the actual monthly rent reduction achieved. Our terms and conditions, which you will receive before the contract is concluded, apply.
What does RentAid do to achieve this?
To enable you to enforce your rights without bearing any financial risk yourself, RentAid covers the full cost of the proceedings and handles the organisation. This funding covers, in particular, the legal and court costs incurred, including the advance payment of court costs – even if the claim is ultimately unsuccessful. In such cases, RentAid will cover, for example, the costs of the opposing lawyers, the costs of expert reports and the court costs for the proceedings. These can quickly run to several thousand euros. You do not need to worry about this.
